Terms of Service

These Terms of Service (“Terms”) form a legally binding agreement between you (“Creator” or “User”) and Cre8rHub Technologies Private Limited (“Cre8rHub”, “we”, “us”). By registering for or using cre8rhub.net (“Platform”), you confirm that you have read, understood, and agree to be bound by these Terms.

If you are accepting on behalf of a business, you represent that you have authority to bind that business.

You must be at least 18 years old and legally capable of entering into contracts under applicable Indian law. The Platform is intended for use by individuals and businesses resident in India, though access from other jurisdictions is not prohibited.

When you create a Cre8rHub account you agree to:

• Provide accurate and complete registration information.
• Maintain the confidentiality of your account credentials.
• Notify us immediately at legal@cre8rhub.net of any suspected unauthorised use.
• Take responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

You represent and warrant that:

• All content, products, and services you offer through the Platform are lawful under applicable Indian law, including but not limited to the Information Technology Act, 2000 and Consumer Protection Act, 2019.
• You hold all necessary rights, licences, and permissions for digital products you sell.
• You will accurately describe your products and services and honour all commitments made to buyers.
• You will comply with all applicable tax obligations, including GST on sales made through the Platform.
• You will not list or sell prohibited or illegal items.

The following are strictly prohibited on the Platform:

• Content that is obscene, defamatory, harassing, hateful, or that incites violence.
• Infringement of any third-party intellectual property rights.
• Spam, phishing, or other deceptive practices.
• Misleading descriptions or fraudulent listings.
• Circumventing Platform fees or payment systems.
• Any activity that violates applicable Indian law or regulation.

We may remove content and suspend accounts that violate these prohibitions without prior notice.

Cre8rHub processes payments through Razorpay, a payment aggregator regulated under the Payment and Settlement Systems Act, 2007 and authorised by the Reserve Bank of India.

• Platform fee: Cre8rHub charges a platform fee on transactions. Current fee rates are published in your dashboard and may be updated with 30 days’ notice.
• Payouts: Creator earnings are disbursed to the verified bank account associated with your KYC profile. Payouts are subject to a holding period as stated in the dashboard.
• Refunds: You are responsible for your own refund policy. Cre8rHub may process refunds where required by law or to prevent fraud.
• Taxes: You are solely responsible for collecting and remitting all applicable taxes on your sales.

You retain ownership of the content you upload to the Platform. By uploading content, you grant Cre8rHub a non-exclusive, royalty-free, worldwide licence to host, display, and distribute that content solely to operate the Platform and deliver your products to buyers.

Cre8rHub retains all rights to the Platform software, design, and branding.

To the fullest extent permitted by applicable law, Cre8rHub shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform. Our total aggregate liability to you shall not exceed the fees we collected from you in the three months preceding the claim.

Cre8rHub is an intermediary under the Information Technology Act, 2000 and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and bears no liability for third-party content hosted on the Platform, subject to prompt removal upon receiving valid notice.

You agree to indemnify and hold harmless Cre8rHub, its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your content or products; (c) your breach of these Terms; or (d) your violation of any applicable law.

Either party may terminate this agreement at any time. Upon termination:

• Your access to the Platform will be revoked.
• Pending payouts for completed orders will still be disbursed per the normal payout schedule.
• Your public profile page will be taken offline.

Provisions that by their nature should survive termination (Intellectual Property, Limitation of Liability, Indemnification, Governing Law) shall survive.

These Terms are governed by the laws of India. Disputes shall first be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Mumbai, Maharashtra. The language of arbitration shall be English.

Nothing herein prevents either party from seeking interim relief from a court of competent jurisdiction in Mumbai.

In accordance with the Information Technology Act, 2000 and the IT (Intermediary Guidelines) Rules, 2021, we have appointed a Grievance Officer:

We may update these Terms from time to time. We will notify you of material changes by email or a prominent notice on the Platform. Continued use of the Platform after the effective date of changes constitutes your acceptance of the updated Terms.
